Is remote online notarization allowed in California? arrow
California grants the Remote Online Notarization (RON) facility by Senate Bill 696 and effective January 1, 2024. All the same, it leaves the total effectivity of RON services by notaries based in California, pending the complete establishment of required technological infrastructures as mandated by the Secretary of State, expected by January 1, 2030, or sooner if possible.
How do you notarize something using the internet in California? arrow
At the moment, California notaries can carry out RON waiting for legal authorization, but what residents of California cannot do is have their documents online-notarized by California notaries and in the meantime should use those out-of-state notaries that permit RON. California will recognize such notarization as performed and valid for those out-of-state notarizations with respect to the laws governing the state where such notarization occurred.
Do I have to be in California to utilize your RON services? arrow
You need not be present in California for using RON services on documents that are intended for use in California. RON can also perform notarization for out-of-state residents by out-of-state notaries. Such notarization has to be aligned with the laws of the commissioning state where the notary is licensed. California will recognize the notarization as valid.
How much does online notary cost in California? arrow
The cost of online notarization varies widely for California residents depending on which out-of-state RON service provider they select. Most of these fees vary according to the provider pricing and complexity that requires notarization. It will be better to refer to some RON service providers to confirm the actual charges.
What kinds of online notarizations does California allow? arrow
Currently, California permits out-of-state notaries authorized to perform RON in their states to notarize for residents of California. These include real estate transactions, affidavits, powers of attorney, and other legal documents. As per the regulations in the state where the notary is commissioned, other types of documents may also be included. This will enable California notaries to notarize similar types of documents electronically for clients, both inside and outside the state, once they have been allowed to do so.
